General Conditions of Participation for the HUG 2024 On-Site Competition

Personio SE & Co KG, Seidlstraße 3, 80335 Munich (hereinafter referred to as "Personio") is organizing a competition for all participants as part of HUG 2024. At the following locations: HUG Munich (October 10, 2024) and HUG Berlin (October 17, 2024), participants will have the opportunity to take part in the Bingo Challenge. Participation in the competition and its implementation are governed by the following provisions (hereinafter referred to as "Terms of Participation").

By taking part in the competition, participants accept the Terms of Participation.

1.1 Participation in the competition is free of charge.

1.2 Participation has the following requirements:

1.2.1 Participants must attend one of the following events on-site: HUG Munich (October 10, 2024) or HUG Berlin (October 17, 2024);

1.2.2 Participants must take part in the Bingo Challenge. This consists of quests and involves filling in 5 boxes in a row on the bingo leaflet (horizontally, vertically or diagonally);

1.2.3 After participants have filled in 5 boxes in a row on their bingo leaflet, they must enter their business e-mail address in the space provided on the front of the bingo leaflet. They must then insert the completed bingo leaflet into the box provided at the Personio stand.

1.3 Each participant may only submit one bingo leaflet to take part in the competition.

1.4 Participants will be contacted by email within 7-14 days to alert them to the HUG Community post about the competition. They have the chance to double their winning chance by leaving a comment under the corresponding post in accordance with the community guidelines. A community account is required.

1.5 Eligible to participate are persons who have reached the age of 18 and are residents in Europe.

1.6 Employees of Personio and employees of any of its partners commissioned by Personio to create and run the competition are excluded from participation.

1.7 Personio reserves the right to exclude participants who use multiple email addresses to increase their chances of winning, technically manipulate the competition or the game process, use unauthorized aids or otherwise violate these conditions of participation or the law from participation in the competition at any time and without prior notice, taking into account the criteria of reasonableness. Personio will make decisions of exclusion to a reasonable extent and on the basis of factual criteria and objective evidence. In the event of exclusion, prizes may also be subsequently withdrawn or prizes already awarded may be reclaimed.

1.8 The participation of lottery agencies and other automatically generated mass participation procedures is excluded and will not be taken into account when determining the lottery winners.

1.9 There is no legal entitlement to participate in the competition.

1.10 The competition ends for participants at HUG Munich on October 31, 2024 at 14:00 (CET) and for participants at HUG Berlin on November 7, 2024 at 14:00 (CET).

2.1 By participating in the competition, participants confirm that they are eligible to participate and can claim the prize. Personio may request proof of entitlement to participate in the competition from participants.

2.2 Neither Personio nor any of its partners commissioned by Personio with the creation and implementation of the competition are responsible for any delays in the submission or transmission of the response and participant data.

2.3 There will be one (1) winner, one for each HUG location (HUG Munich and HUG Berlin). One winner will be selected at random from all eligible entries for each of the locations.

2.4 The winner will receive the following prizes:

2.4.1 at the HUG site in Munich: a voucher worth €800 for the hotel "Das Achental"

2.4.2 at the HUG location in Berlin: a voucher worth €750 for the "Resort Mark Brandenburg" hotel

2.5 Personio will notify the winners by email to the email address they provided on the bingo card within two weeks of the end of the competition. Personio will also announce the winners in a post in the Personio Community for HUG 2024.

2.6 Participants are responsible for the accuracy of the email address provided. If a winner cannot be notified due to incomplete or incorrect contact details, the claim to the prize shall lapse.

2.7 If the winner does not confirm acceptance of the prize within three weeks of the notification of the prize being sent, the prize will be forfeited.

2.8 The non-cash prizes will be sent by Personio or a third party commissioned by Personio by post to the postal address provided by the winner as well as by e-mail. Delivery within Europe will be made once free of charge. Any additional transportation costs, costs for a replacement delivery or customs duties shall be borne by the winner. The place of performance shall remain Personio's registered office despite the assumption of shipping costs.

2.9 The entitlement to the prize lapses if the prize cannot be sent within three weeks of acceptance of the prize and the reason for this lies with the winner.

2.10 The prizes shown as part of the competition may differ from the items or services presented to the winners, provided that they are equivalent in terms of the prizes described from the perspective of an average participant.

2.11 If the prize shown in the description of the competition cannot be sent or can only be sent under unreasonable circumstances (e.g. the prize originally intended is no longer available), the winner(s) will receive an equivalent replacement.

2.12 Payment of the prize or any prize substitute in cash or in kind, as well as their exchange, is not possible.

2.13 The claim to the prize or the prize substitute cannot be assigned.

3.1 If claims are asserted against Personio due to inadmissible content or violations of the law or these conditions of participation for which one or more participants are responsible, the participants concerned shall indemnify Personio against the claims to the extent of their responsibility upon first request and support Personio in the defense against the claims. The indemnification shall include the necessary legal costs.

4.1 Personio reserves the right to terminate the competition prematurely or extend its duration at any time without prior notice and without giving reasons.

4.2 Personio will make use of the option of premature termination in particular if the proper execution of the competition cannot be guaranteed for technical or legal reasons.

4.3 If such a termination is caused by the behavior of a participant, Personio may claim compensation from this person for the damage incurred.

5.1 Personio shall be released from all obligations upon delivery of the prize, unless an earlier point in time is specified in these Terms.

5.2 The prizes of the Competition may be provided by a partner (hereinafter referred to as "Sponsor"). Personio shall not be liable - subject to its own fault as set out in these liability provisions - for any items or services won that are provided by a sponsor and not by Personio itself. The warranty and guarantee conditions of the respective sponsor apply, provided that these do not restrict the participants and can be transferred by Personio to the participants. Claims for possible material defects and defects of title in the prizes provided by the sponsors are to be made exclusively against them.

5.3 Personio is not liable for the insolvency of a sponsor or the consequences of this for the implementation of the Competition.

5.4 Personio is only liable for damages if the damage is due to intent or gross negligence. In addition, Personio is liable for the breach of a cardinal obligation due to simple negligence only. Cardinal obligations are those, the fulfilment of which enables the proper performance of the Competition and the achievement of the purpose of the contract in the first place and on the compliance with which a participant may regularly rely. In this case, however, Personio shall only be liable for the foreseeable, contract-typical damage. Personio shall not be liable for the slightly negligent breach of the obligations mentioned in the above sentences by others.

As far as the liability of Personio is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents of Personio. In case of grossly negligent breach of duty by vicarious agents of Personio, the aforementioned limitations for slightly negligent breach of essential duties apply accordingly.

The above limitations of liability shall not apply in the event of injury to life, body or health. Liability under the Product Liability Act remains unaffected.

6.1 Personio collects, processes, uses and stores the personal data provided by the participants for the purpose of conducting and handling the competition in accordance with the statutory provisions and within the scope of the consent given by the participants in each case. For this purpose, Personio is entitled to transmit the winner's data to transport companies, cooperation partners, sponsors and cooperation partners of the sponsors (e.g. for the delivery of the prize). Neither Personio nor third parties will use the personal data of participants for other purposes without their express consent.

6.2 Information on the processing of personal data in the context of participation in competitions can be found in Personio's privacy policy.

6.3 Each participant is free to revoke their declaration of participation at any time and hereby object to the use of their data in the context of the competition. To do so, the participant must inform Personio of his/her revocation by e-mail at the following e-mail address: community@personio.de.

7.1 Personio reserves the right to change these conditions of participation at any time without notice.

7.2 If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall not be affected.

7.3 The law of the Federal Republic of Germany shall apply to the Competition and the Terms and Conditions.
